LEGISLATIVE COUNCIL
May 18, 1999
1. ROLL CALL
The Legislative Council meeting was called to order at 12:40 p.m. by Senator
Miller, Legislative Council Chair, in the Butrovich Room, Capitol Room 205.
The roll was taken. In attendance were Council members Miller, Donley,
Hoffman, Kelly, Leman, Pearce, Barnes, Berkowitz, Cowdery, Ogan, G. Phillips,
and Rokeberg. Members absent were Porter and Torgerson. Staff present were
Varni, Cook, Finley, Ibesate, Kempton, McCauley and Schofield.
2. APPROVAL OF APRIL 8, 1999 MEETING MINUTES
Senator Donley moved the minutes of the April 8, 1999 meeting be approved.
The motion was approved unanimously.
3. APPROVAL OF FAIRBANKS LIO/LEGISLATIVE OFFICE SPACE
Representative Barnes moved approval of the office space for the Fairbanks
LIO/Legislative Office proposal from Denali State Bank in the amount of
$9,133.75 per month ($1.97 first floor, $1.77 second floor for total square
footage of 5,035) be approved. With no objection, the motion was approved
unanimously.
4. CHANGE TO LEGISLATIVE SESSION MOVING & TRAVEL POLICY
Representative Barnes moved the proposed amendment to the session moving and
travel policy be approved. With no objection, the motion was approved
unanimously.
5. APPROVAL OF TERRY MILLER LEGISLATIVE OFFICE BUILDING RENOVATION
CONTRACTS
Senator Kelly moved the Council approve the expenditure, solicitation and
award of the Terry Miller Legislative Office building renovations from the FY
99 Legislative Affairs Agency and the legislative space renovation capital
funds. With no objection, the motion was approved unanimously.
6. APPROVAL OF LEXIS LAW PUBLISHING STATUTE SUPPLEMENT INCREASE AND
DISCUSSION OF TWO NEW IDEAS IN CODE PUBLISHING
Ms. Pam Finley, Revisor of Statutes, informed the Council of the recent
request by Lexis Law Publishing to amend the publishing contract. She stated
that the price per page for the annual supplement and temporary and special
acts pamphlet increased from five to five and one-half cents per page for the
State, and from ten to eleven cents per page for the private users. She also
stated that Lexis Law Publishing has requested that an annotation citator be
published as an additional volume in the sets of Alaska Statutes. It would
cost $40 for the private users and $20 for the State. Also, Lexis Law
Publishing has requested that it publish as part of the Alaska Statutes a
hardbound volume containing the ethics opinions of the Alaska Bar Association.
Representative Barnes moved to amend the publishing contract. With no
objection, the motion was approved unanimously.
7. APPROVAL TO PURCHASE COMPUTERS
Mary Gore, Legislative Assistant to Council Chair Miller, briefed the Council
regarding the results of the legislative office computer survey. She
indicated that the IS Subcommittee was not ready to present their
recommendations but would have an update for the Council at the next Council
meeting.
8. CHANGE TO LEGISLATIVE DRAFTING MANUAL
Senator Donley moved to add sections creating uncodified laws to the
legislative drafting manual. With no objection, the motion was approved
unanimously.
9. LATE PER DIEM REQUEST
Representative Barnes moved that the Council approve the late travel request by
Representative Davies. Senator Pearce objected.

Rokeberg
NAYS: Leman, Pearce, and Ogan
ABSENT: Hoffman, Torgerson and Porter
The motion was adopted.
10. HOMER LIO UPDATE
Representative Phillips informed the Council that the convenience store located
in the same building as the LIO had problems with gas fumes. She stated the fuel
tank started to leak and was removed. It has not affected the operation of the
LIO.
11. NEW BUSINESS
Senator Leman asked the Council to authorize up to $25,000 to retain legal
counsel to represent the Legislature's interest in the case of Planned Parenthood
of Alaska v. Karen Perdue, No. 3AN-98-7004 CI. The legal representation will
take the form of intervention in the litigation as a Co-defendant, or, in the
event an intervention motion is not granted by the Alaska Supreme Court, as
amicus curiae defending the position of the Department of Health and Social
Services.
Representative Berkowitz amended the motion to $10,000:

ABSENT: Hoffman, Porter, and Torgerson
The motion failed.
Senator Leman's original motion not to exceed $25,000:
YEAS: Miller, Donley, Hoffman, Leman, Pearce, Barnes, Cowdery, Ogan,
Phillips, and Rokeberg
NAYS: Kelly and Berkowitz
ABSENT: Porter and Torgerson
The motion passed.
12. NEW BUSINESS
Council Chair Miller appointed himself, Senator Pearce, Representative Porter,
and Representative Barnes to the Personnel Policy Subcommittee to work during the
interim to draft proposed personnel policy changes to present to a joint Rules
Committee meeting before next session.
The meeting was adjourned at 1:05 p.m.
